Frank Schmidt, Ilion Attorney, Dies At Home

Ilion - Frank A. Schmidt, 75, prominent Ilion attorney and former district attorney of Herkimer County, died yesterday [March 12, 1951] at his home, 29 Armory St., after a long illness.

Mr. Schmidt was born July 28,1875, in Ilion, the son of John V. and Katherine Schmidt. He graduated from the Ilion High School in 1893. He was employed by the Remington Arms Company as an apprentice tool maker until 1899 when he entered Cornell University.

He was graduated from the Cornell Law School in 1902 with a Bachelor of Law degree and was admitted to the bar May 13, 1902, before the Appellate Division of the Supreme Court at Rochester. He entered the law office of James Conkling in Ilion and later opened his own office.

Was District Attorney

Early in his career, he was elected Justice of the Peace of the Town of German Flatts and later served as Town Attorney for many years. He was elected to one term as District Attorney in 1909, serving until 1912.

He was a member of the New York State Bar Association, a past president of the Herkimer County Bar Association, and was in partnership with Carl W. Peterson, present Herkimer County Judge.

From 1939 to 1944 he was president of the Ilion National Bank and Trust Company, and until his retirement in 1947 was chairman of the board of directors. He was also a director for many years of the Ilion Savings and Loan Association and served various terms as its vice president.

Active in Elks

He was a member of Phi Delta Phi national honorary legal fraternity, a charter member of Ilion Lodge 1444, BPOE, a past president of the Ilion Community Club, past master of Ilion Lodge 591, F. & A. M., and past district deputy of the Herkimer, Fulton and Montgomery Masonic District, he was a past Potentate of Ziyara Temple, Nobles of the Mystic Shrine, a member of Iroquois Chapter, Royal Arch Masons, Little Falls Commandry, Knights Templar, president of the New York State Shrine Council in 1930, and a member of the Conversation Club and the Down and Out Club of Herkimer.

He was an exempt member of Hose Company No. 1, Ilion Volunteer Firemen and served at one time on the village Water Board.

Masonic Trustee

He was a member of the St. Augustine's Episcopal Church and was for many years a trustee of the Masonic Hall and Asylum Fund which administers the Masonic Home in Utica.

He was a law partner of Albert Schneider, present district attorney of Herkimer County.

He married the former Florence Wells of Antrim, Pa., Feb. 20, 1912.

Besides his wife, he leaves two daughters, Mrs. Robert Dennis, Herkimer and Mrs. Gordon Norris, Syracuse; one sister, Mrs. Fatanitza Bennett, Albany and four grandchildren.

Funeral services will be held at 2 p. m. Thursday, at the Masonic Temple where Masonic services will be held by Ilion Lodge 591, F&AM. The Rev. Ernest Brooks Pugh will officiate and past masters of the lodge will be honorary bearers. The body will be taken to Waterville for cremation.

Friends may call at the late home on Tuesday and Wednesday afternoons and evenings.
